Terms of service

These are the terms and conditions on which we sell all Goods to you and govern your use of our website. Please read these terms in full before you use this website. Your continued use of this website and ordering of Goods confirms your acceptance of these terms.

1) Supply of Goods

1.1 The description of Goods is as set out in the website, brochures and any other form of advertisement. Any description is for illustrative purposes only and whilst every effort is made to ensure product descriptions are accurate there may be small discrepancies in the size and colour of goods described.

1.2 In the case of Personalised Goods, whereby they are made to the consumers specific requirements, it is the consumers responsibility to ensure that any information or specification provided is accurate.

1.3 All Goods which appear on the website are subject to availability.

1.4 Necessary changes will be made to Goods to ensure they comply with any applicable law or safety requirement.

Payments

1.5 Prices and charges include VAT at the rate applicable at the time of order.

1.6 Payment must be made immediately upon submitting your order. This can be done by submitting your credit or debit card details or by using our PayPal or Apple Pay payment options.

Shipping/Delivery

1.7 Your order will be processed and delivered without undue delay and in accordance with our shipping policy. Delivery is only made to addresses within the UK.

1.8 Please allow up to 7 working days for delivery following the dispatch of your order.

1.9 If your order has not been received within 7 working days, please contact us at hello@cocomeraki.com to bring the matter to our attention.

Cancellations, returns and refunds

1.10 All customers have the right to cancel their order under the Consumer Contracts (Information, Cancellation & Additional Charges) Regulations.

1.11 Your right to cancel an order for goods starts the moment you place your order and ends 14 days from the day you receive your goods.

You can withdraw your order, without any reason or liability, by telling us before the item is dispatched. This excludes personalised items which are made to order and may be already subject to processing.

1.12 Once Goods have been dispatched please notify us via email to exercise your right to cancel the order before the cancellation period has expired and you shall be provided with return details.

1.13 If you are in possession of the goods you are under a duty to retain them and take reasonable care of them. The Goods must be returned in their original, unopened packaging. We may make a deduction from the reimbursement for loss of value of Goods returned, if the loss is as a result of unnecessary handling by you.

1.14 You are responsible for paying the cost of returning Goods, unless we delivered them to you in error or the item is damaged or defective, as soon as possible once you have cancelled the order. Please ensure you retain proof of postage as we cannot accept responsibility for returns lost in the post.

1.15 We reserve the right to make a charge not exceeding our direct costs if you do not return the goods or return them at our expense.

1.16 Once the Goods have been received and inspected, any sum debited to us will be refunded to you within 72 hours, including the cost of delivery (excluding supplementary delivery to the standard delivery service offered).

1.17 You will not have any right to cancel an order for the supply of any of the following goods:

(a) the supply of goods that are made to the customer's specification or are clearly personalised.

1.18 In addition you will lose your right to cancel if you:

(a) unseal goods that are not suitable for return if they are unsealed;

(b) combine goods with other goods after delivery so that they become inseparable.

Privacy

1.19 We respect your privacy and comply with the General Data Protection Regulations with regard to any personal information supplied by you during the ordering process.

1.20 Where personal data has been supplied in order for us to provide goods to you we will comply with our obligations imposed by the Data Protection Laws, including:

(a) Before or at the time of collecting personal data we will identify the purpose for which the information is being collected;

(b) We will only process personal data for the purposes identified;

(d) We will implement technical and organisational measures to ensure your data is secure.

Excluding Liability

1.21 The supplier does not exclude liability for:

(a) Any fraudulent act or omission;

(b) For death or personal injury caused by the negligence or breach of the suppliers legal obligations;

Law and jurisdiction

1.22 These terms and conditions are governed by English law. Any dispute arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the Courts of England and Wales.

2) Website access

2.1 It is not necessary to register with us in order to use most parts of this website. However, particular areas of this website will only be accessible only if you have registered.

Use of website

2.2 This website may be used for your own private purposes and in accordance with these terms and conditions.

2.3 Printing and downloading of material from this website is prohibited without our prior written consent.

Website uptime

2.4 All reasonable measures are taken by us to ensure that this website is operational all day, every day. However, occasionally technical issues may result in some downtime and accordingly we will not be liable if this website is unavailable at any time.

2.5 Where possible we always try to give advance warning of maintenance issues that may result in website down time but we shall not be obliged to provide such notice.

Visitor provided material

2.6 Any material that a visitor to this website sends or posts to this website or its social media pages shall be considered non-proprietary and non confidential. We shall be entitled to copy, disclose, distribute or use for such other purpose as we deem appropriate all material provided to us, with the exception of personal information, the use of which is covered under our Privacy Policy.

2.7 When using this website you shall not post or send to or from this website any material:

(a) for which you have not obtained all necessary consents;

(b) that is discriminatory, obscene, pornographic, defamatory, liable to incite racial hatred, in breach of confidentiality or privacy, which may cause annoyance or inconvenience to others, which encourages or constitutes conduct that would be deemed a criminal offence, give rise to a civil liability, or otherwise is contrary to the law in the United Kingdom;

(c) which is harmful in nature including, and without limitation, computer viruses, Trojan horses, corrupted data, or other potentially harmful software or data.

2.8 We will fully co-operate with any law enforcement authorities or court order requiring us to disclose the identity or other details of any person posting material to this website in breach of Paragraph 2.7.
